Please read these Terms of Use carefully before using the ForexCommand website or desktop application. By accessing or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and ForexCommand ("we," "us," or "our") governing your use of the ForexCommand website located at www.forexcommand.com and the ForexCommand Windows desktop application (collectively, the "Service"). By accessing the website, joining the waitlist, or installing and running the desktop application, you accept these Terms in full.

2. Description of Service

ForexCommand is a Windows desktop overlay application that displays real-time forex market data including trading session activity, economic news feeds, market readiness scores, and a trade journal integration with MetaTrader 5. The Service also includes this website, which provides product information and a waitlist for early access.

3. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the ForexCommand desktop application on a single Windows device for your personal, non-commercial purposes. You may not sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the application.

4. Financial Disclaimer

ForexCommand is an informational tool only. It does not provide financial advice, investment advice, trading advice, or any other form of advice.

  • The data, scores, indicators, and metrics displayed by ForexCommand are for informational and educational purposes only.
  • Past market conditions shown by the application are not indicative of future results.
  • Trading foreign exchange ("forex") on margin carries a high level of risk and may not be suitable for all investors. You could lose some or all of your invested capital.
  • ForexCommand does not recommend or endorse any specific currency pair, trading strategy, or broker.
  • You are solely responsible for your own trading decisions. We are not liable for any losses you incur as a result of relying on information displayed by the Service.

Always consult a qualified financial advisor before making investment or trading decisions.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Reverse-engineer, decompile, or disassemble the desktop application
  • Attempt to gain unauthorized access to any systems or networks
  • Distribute malware or engage in any activity that could harm other users
  • Reproduce, redistribute, or resell any part of the Service without our written consent

6. Intellectual Property

The Service and all its original content, features, and functionality are owned by ForexCommand and are protected by intellectual property laws. The "ForexCommand" name and all related logos are trademarks of ForexCommand. You may not use them without our express prior written consent.

7. Refund Policy

Lifetime Plan: If you purchase a Lifetime license and are not satisfied, you may request a full refund within 30 days of your purchase date. To request a refund, contact us at the email address listed in Section 10. Refunds are not available after 30 days.

Pro (Subscription) Plan: You may cancel your subscription at any time. You will retain access through the end of the current billing period. No partial refunds are issued for unused portions of a billing period.

Free Plan: No charges apply.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOREXCOMMAND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR LOSS OF TRADING CAPITAL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

10. Governing Law and Contact

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, with proceedings conducted in Texas.
